DRAFTING OF WILL111

A wrongly-worded Will is as good as not having Will at all.To ensure your loved ones get your hard-earned assets, you must get the Will drafted in legal terms. At OnlineWill, it is our job to assist you in translating your desires into a legally-worded document - the Will.

The process of drawing up a Will starts with you filling in the required information and sending it to us. Our team of lawyers will then review the information and draft a customised Will to you through email. All you have to do is take a printout of it and sign it.

Write your WILL in just 3 easy steps.

WILL EXECUTION

The process of drafting a Will is incomplete unless you appoint an executor, who is capable of carrying out your wishes as mentioned in the Will. It is a no-brainer that the executor must be someone who is not only trustworthy, but also who is certain to outlive you. We offer you the option of appointing us, a professional company to be your executor.

Below is a brief synopsis of our role as an executor:

  • Identifying assets and liabilities of the deceased
  • Applying for and obtaining the Grant of Letter of Administration i.e a Succession Certificate or a Probate
  • Paying debt, duties and expenses
  • Preparing tax returns
  • Protecting business interests
  • Distributing the assets to the beneficiary/ies according to the directions in the Will

GUIDANCE IN REGISTRATION

Though not mandatory in India, registration of a Will is very important as it helps reduce the risk of it being tampered. When you register the Will with the sub-registrar, a copy of the Will is safely stored with them, while another copy can be retained by you. Of course, registration does not by-pass probate requirements of a Will.

Given the fact that registration reduces the risk of fraud, we strongly recommend our clients to register theirs. However, many a time the process is not completed as it is quite time-consuming. One is required to schedule an appointment with the Sub-registrar and then get the documents scanned and approved. We offer to carry out this entire process for you to save your time and energy.

DIGITAL WILL

Often confused with an online Will, a digital Will is actually a special type of will that allows you to pass on your online 'properties', such as your social networking account or an e-mail account. You can use our secure Digital Will vault to store all your digital assets safely with us. To access data from this Will, all you need to do is enter the unique access code that will be sent to you.

Twitter will deactivate an account upon the request of an estate executor or a verified immediate family member once a copy of a death certificate and other pertinent information is provided.

Facebook has two options. First, the site enables profiles to be turned into memorials. The account is locked, but other users can still interact with the deceased’s profile by posting comments, photos and links. The other option is to remove the account, upon special request by an immediate family member or executor.

Google has recently established a new feature called "inactive account manager," which prompts users to decide the fate of their accounts should they die. If the account user does not make a selection, Google’s policies are pretty strict. It warns survivors that obtaining access to a deceased person’s email account will be possible only “in rare cases.”

Yahoo will "delete the user account" and any contents permanently for privacy. In order to do it yahoo has a process in place which the user family will need to follow. To protect the privacy of your loved one, it is Yahoo policy to honor the initial agreement that they made with customers, even in the event of their passing.

Our Digital WILL is an online, cloud-based vault service that allows users to securely store and update ‘internet account’ details anytime and anywhere. Digital WILL encrypts and decrypts the data using AES-256. It offers users the ability to protect their digital legacy during their life and even after. Digital WILL allows you to name a beneficiary who would gain access to your digital asset. Moreover, you can also mandate what he or she must do with your account.

The key features of Digital WILL are:

  • Identifying assets and liabilities of the deceased
  • Applying for and obtaining the Grant of Letter of Administration i.e a Succession Certificate or a Probate
  • Paying debt, duties and expenses
  • Preparing tax returns
  • Protecting business interests
  • Distributing the assets to the beneficiary/ies according to the directions in the Will

CODICIL

In addition to the Will, there is a document called codicil that contains details of changes you make to the contents of the Original Will. The changes may be in reference to the assets you own or the beneficiaries who are going to inherit them. A codicil is very useful to make minor changes to a Will. But where there are a whole lot of changes, a brand new Will is your best bet.
